Our services allow our users to create their own content, such as websites containing images, text and videos. As we offer our services as selfmanaged, we do not have direct control on what content is uploaded by our users.

Because of this, it could happen that content hosted on our services may be unmistakably unlawful. If that is the case and you wish to take action, you will first need to contact the party that is primarily responsible for removing the content.

In order of importance these parties are:

• The person or organisation that uploaded the content
• The website's administrator
• The domain name's registrant
• The hosting provider
• The domain name's registrar

Notice and Takedown procedure

It's possible you are unable to reach an agreement with the the person or organisation that uploaded the content, the website's administrator or the domain name's registrant. In that case you can choose to start a Notice and Takedown procedure at TransIP.

The Notice and Takedown procedure is started by issuing a request (Notice). After the content is established as unmistakably unlawful, this may lead to the content being made inaccessible (Takedown). You can issue a request for a Notice and Takedown by contacting us via the 'Contact' button in your control panel or via email to the email address support@transip.eu.

We will require sufficient information and evidence in order to go through with the procedure. Make sure you mention where the content is located, for example by supplying direct URLs and/or IP addresses and why you deem this content unmistakably unlawful.

Unmistakably means there can be no doubt about the content being unlawful. You can prove this by supplying source files or other documents which prove that one or more rights are being infringed upon. It is also important to provide evidence that the infringing party was not allowed to make the content public.

We also request proof of contact or of an attempt to contact the offending person / organisation, the website's administrator or the domain name's registrant. If applicable, we will also need proof of replies from these parties and an indication on why this hasn't led to an appropriate solution.

Follow-up on the Notice and Takedown procedure

After we've received all the required information to start the Notice and Takedown procedure, we will contact the user that owns the domain name and/or website. Among other things, we will check if the content is unmistakably unlawful. If that is the case, we will render the content unaccessible.

We will inform both you and our user of any developments regarding the procedure.
